PAY LESS, PAY LESS. OUR CLIENT PAYS $614,658 LESS.

An ASX-listed large format retail tenant in South Sydney exercised their option and the landlord proposed a net market rent $385,665 per annum greater than what they were paying (a 78% increase). The evidence and the lease justified a higher rent, but nowhere near what was proposed. Our advice reduced the increase by $122,932 per annum (a 32% reduction on the proposed increase).

WHAT WE FOUND

Although the lease was for a large format retail tenancy and wasn't subject to the Retail Leases Act 1994 (NSW), the market rent review clause within the lease itself was based on section 31 of the Act. This meant that the market rent review must be undertaken on a net effective basis.

The landlord's market rent review notice however, appeared to provide a net face market rent and didn't seem to account for numerous factors we noted in our advice.

The landlord's notice didn't appear to provide any indication of an incentive having been considered in a market where the evidence indicated incentives ranging between 10.0% and 17.5%.

In our view, the size, configuration, and layout of the subject tenancy, particularly when taken within the context of the specific lease terms justified a significantly lower net market rent than what the landlord had proposed.

OUTCOME

$614,658 SAVED OVER THE NEXT FIVE YEARS.

After some back and forth with the landlord, our client was able to reach agreement on a net effective market rent that was within the market parameters we identified as being justifiable within the context of the evidence and the lease.

Our advice not only secured a significant reduction in the rent our client would have otherwise been required to pay, it also removed the need for a lengthy and costly market rent review determination process.

The tenant was referred to us by one of their trusted advisors who had a conflict of interest. Rasalan's intentional focus on providing client-aligned and exclusive tenant-side market rent review valuation advice was a critical factor in being provided an instruction to work on behalf of this ASX-listed large format retailer.
